Rafferty's victim are not guilty!

Post  grasshopp3r on Fri Jan 23, 2009 2:58 pm

Good news!

I have not seen an article or the case transcript, however, I heard that Kevin Raley was not guilty and prevailed on the skill vs. chance of poker argument.

9 News has an article on the case. Please digg the article, which includes signing up to digg. http://digg.com/world_news/Colorado_man_beats_gambling_charge_by_proving_poker_is_skill

One of the ways that we can make our issues more visible is through digg.

Thank you.

The case is scheduled for arguements at the Court of Appeals in June.

I will also editorialize a bit here. This is a very risky strategy for those that want to keep poker in the "gambling" definition. The presumption is the trial judge gets the ruling correct, especially to present a credible defense in a criminal trial. It would be more expedient to win this ruling and not to have to set up a defense on the issue of poker as a "skill" game, however, I think that the defense wins more than 80% of the time, anyway.
