Good news!
I have not seen an article or the case transcript, however, I heard that Kevin Raley was not guilty and prevailed on the skill vs. chance of poker argument.

I don't believe this is the same case but here is a ruling in PA.

The case is scheduled for arguements at the Court of Appeals in June.
I will also editorialize a bit here. This is a very risky strategy for those that want to keep poker in the "gambling" definition. The presumption is the trial judge gets the ruling correct, especially to present a credible defense in a criminal trial. It would be more expedient to win this ruling and not to have to set up a defense on the issue of poker as a "skill" game, however, I think that the defense wins more than 80% of the time, anyway.
